Definitions
  1. The summit is the 2023 Diversity and Inclusion Summit to be held on 8 and 9 September 2023 at Engineers Australia WA (“Summit”).
  2. The organiser is RedHead Communications Pty Ltd (“Organiser”).
  3. A registrant is any natural person that is registered to attend the Summit as an attendee, a representative of a sponsor, a sponsor, a representative of a speaker or as a speaker
    (“Registrant”).
  4. Registration means the license for a natural person to attend the Summit as a Registrant. (“Registration”).
General Terms & Conditions
  1. A Registrant must register with the Organiser to attend the Summit in person.
  2. These Terms and Conditions apply to all Registrants and form part of the Registrant’s Registration.
  3. If any part of these Terms and Conditions is held by any court to be illegal, void or unenforceable, such determination shall not impair the enforceability of the remaining parts of these Terms and Conditions.
  4. These Terms and Conditions are governed by the laws of the State of Western Australia.
Health and safety (including COVID-19 safe practices)
  1. The health and safety of Registrants is paramount to the Organiser.
  2. The Registrant understands that COVID-19 vaccination(s) or a valid medical exemption may be required to attend the Summit’s venue.
  3. The Registrant understands that the Organiser will ensure all health and safety measures are in place during the Summit as is reasonably practicable and foreseeable.
  4. The Registrant understands that the Summit will follow all Government advice regarding COVID-19 health directions including working with the venue to ensure the Summit is delivered in accordance with all COVID-19 safe health and safety requirements.
  5. The Registrant warrants its unconditional cooperation in ensuring they comply to the respective venue’s health and safety practices, including COVID-19 safe practices.
  6. In the event a Registrant fails to comply with any part of clause 3, the Organiser reserves the right to terminate the Registrant’s registration immediately. No refund will be given.
Registrant Summit Attendance Payments
  1. Where a payment is required to register for the Summit, payment must be paid in full to guarantee registration.
  2. If payment is not made at the time of booking, registration will be provisional only.
  3. All provisional registrations will be terminated 3 working days before the Summit commencement date.
Late Registrations
  1. A late registration is any registration made less than 30 days before the Conference start date.
  2. The Organiser cannot guarantee that any or all Summit collateral will be available to late registering persons.
Registrant substitution
  1. The Registrant may nominate an alternative person from their same organisation to attend up to 48 hours prior to the commencement of the Summit, at no extra charge.
  2. All substitution nominations must be in writing to the Organiser.
Cancellation of the Summit by the Organiser
  1. In the event of a full cancellation of the Summit by the Organiser, all registration fees will be refunded in full.
  2. The Organiser does not accept any liability for losses incurred in the Summit being cancelled due to unforeseen circumstances or any other event that renders performance of the Summit inadvisable, illegal, impracticable, or impossible.
  3. An unforeseen event includes yet shall not be limited to: an Act of God; infectious disease outbreak, industrial disruptions, service provider failures, governmental restrictions and/or regulations; war or apparent act of war; terrorism or apparent act of terrorism; disaster; civil disorder, disturbance, and/or riots; curtailment, suspension, and/or restriction on transportation; or any other emergency.
Postponement of the Summit
  1. In the event of a postponement of the Summit by the Organiser, all registrations will carry over to the new dates.
  2. The Organiser does not accept any liability for losses incurred in the Summit being postponed due to unforeseen circumstances or any other event that renders performance of the Summit inadvisable, illegal, impracticable, or impossible.
  3. An unforeseen event is defined in 6.3.
  4. In the event of a postponement the Organiser will consider requests for cancellation and refund pursuant to clause 10.
Alterations to the Summit and/or Program
  1. The Organiser reserves the right to make alterations to the Summit’s programs, venue(s) and timings at any time and without notice.
  2. Where the Organiser is required to replace a speaker due to unforeseen circumstances, the Organiser will replace the speaker with another speaker or speaker in a similar
    stream where possible.
General cancellation and refunds
  1. In the event a Registrant intends to cancel their Registration, refunds will not be provided to a Registrant on a ‘change of mind’ basis.
  2. A general request for refund must be in writing to the Organiser with each request considered on a case-by-case basis.
  3. A general request for refund must be made no later than 5 working days before the commencement date of the Summit.
Registrant COVID-19 diagnosis and isolation
  1. In the event a Registrant contracts COVID-19 and will be in insolation for the duration of the Summit the Organiser will provide the Registrant with a full refund, minus a $150 administrative fee.
  2. Requests for cancellation and refund under clause 10 must be in writing to the Organiser with evidence proving your COVID-19 diagnosis.
Government COVID-19 imposed travel related refunds
  1. Should it be necessary for a Registrant to cancel their registration due to Government imposed travel restrictions, the Organiser will provide the Registrant with a full refund, minus a $150 administrative fee.
  2. Requests for cancellation and refund under clause 12 must be in writing to the Organiser with evidence proving the Registrant’s inability to attend is explicitly restricted or prevented due to Government imposed travel restrictions.
Accommodation bookings and refunds
  1. For accommodation booked as part of the registration process, in the event the Registrant seeks to cancel their accommodation they are required to contact Pan Pacific Perth directly and make such a request subject to the Pan Pacific Perth’s hotel cancellation policy.
  2. Any accommodation bookings, including any with Pan Pacific Perth are deemed to have been made by the Registrant personally, the Organiser takes no responsibility for accommodation bookings made by Registrants.
Insurance
  1. Registration fees do not include Registrant personal insurance of any kind.
  2. Registrants are responsible for making their own travel insurance policy arrangements, if any.
  3. The Registrant indemnifies the Organiser from any liability as a result of any losses incurred by the Registrant failing to arrange their own insurance.
Registrant privacy and data protection
  1. By registering for the Summit, the Registrant consents to having their details distributed to Summit attendees, sponsors and speakers. If the Registrant wishes to opt out then they must contact the Organiser via email info@diversityandinclusionsummit.com.au stating their name, organisation, and email address in order to opt out of detail distribution no later than 7 days before the commencement of the Summit.
  2. The Organiser is committed to protecting Registrant privacy and will manage Registrant’s privacy as provided for under relevant privacy legislation and privacy protection principles.
  3. Websites and links of the Organiser’s websites may link to other websites and networking tools provided for the convenience of the users. The contents of these websites are maintained by their owners, for which the Organiser takes no responsibility.
Summit photography and filming
  1. For promotional purposes, photography and video production will be taking place during the Summit.
  2. By registering for the Summit, the Registrant authorises the Organiser to take photos and video at the Summit.
  3. A Registrant agrees that the Organiser is the owner of the copyright, photographs, video and social media content and that it may use photographs, video and social media content for any purpose it considers appropriate, including publicity, education or other activities and may earn income for the Organiser’s own benefit.
  4. Subject to 16.5, the Registrant waives any moral rights pertaining to the copyright of photographs, video and social media content pursuant to 15.3.
  5. Registrants who do not wish to be filmed or recorded should advise the organisers by email to info@diversityandinclusionsummit.com.au prior to the Summit’s commencement date.
Access and special needs requirements
  1. Registrants with special access or special needs requirements are to provide the Organiser with their requirements at the time of registration.
  2. The Organiser cannot guarantee that special access or special needs will be met where the Registrants requirements are provided less than 30 days before the Summit commencement date.
Speaker’s views, advice or opinion
  1. By registering, the Registrant understands that the views expressed by the Organiser’s Summit speakers are the Speaker’s own.
  2. The Organiser does not accept liability for advice given, or views expressed, by any speaker at the Summit or in any material provided to Registrants by its sponsors or
    speakers.
